ONLINE SYSTEM / SERVICE

Please READ carefully by purchasing this product, you (herein referred to as “Client”) agree to the follow terms stated herein.
Gestion Amya inc (herein referred to as “PhotoCoach International” or the “Company”) agrees to provide, the “PhotoCoach “Core” Business System” (herein referred to as “System”) as identified in the online commerce-shopping cart.

INTRODUCTION

Client agrees to the terms and conditions outlined in this Online Contract (“Contract”) with respect to the goods, services and information provided by or through the PhotoCoachonline.com Site.
This Contract constitutes the entire and only agreement between the Company and Client, and supersedes any and all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the goods, services and information provided by or through the Site, and the subject matter of this Contract. Client agrees to review this Contract prior to purchasing anything and purchase of a good or service shall be deemed acceptance of this Contract.

DISCLAIMER

Client understands that Andre Amyot or any PhotoCoach partner (herein referred to as “Experts”) and Gestion Amya inc, are not manager, business manager, or financial analyst, or accountants. Client understands that Experts have not promised, shall not be obligated to and will not perform the following tasks; (1) We will not procure or attempt to procure employment or business or sales for Client; (2) We will not perform any business management functions including but not limited to, accounting, tax or investment consulting, or advice with regard thereto.
You as the Client understand that there are no other relationships between the parties after the conclusion of this System. If the Client and the Experts decide to continue their relationship, a separate agreement will be created.

THE SERVICE, CONTENT, GOODS AND SERVICES FROM OR THROUGH THE SERVICE ARE PROVIDED “AS-IS,” “AS AVAILABLE,” AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO THE DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE).
THE SOLE AND ENTIRE MAXIMUM LIABILITY OF COMPANY, FOR ANY REASON, AND CLIENT’S SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE AMOUNT PAID BY THE CUSTOMER FOR THE PARTICULAR ITEMS PURCHASED.
COMPANY AND ANY OF ITS AFFILIATES, DEALERS OR SUPPLIERS ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LITIGATION, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN COMPANY AND CLIENT. THIS SITE AND GOODS AND SERVICES WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS. SOME STATE STATUTES MAY APPLY REGARDING LIMITATION OF LIABILITY.

EARNING DISCLAIMER

The entire Team of Experts of PhotoCoach International has made all the efforts possible to accurately represent our products and the potential.We offer no guarantee that you will automatically earn any amount of money while using the techniques and ideas included in these products. Examples cited in these products are not to be interpreted as a promise or guarantee of earnings. The Client’s earning potential is entirely dependent on the efforts deployed in implementing the System, the concepts, ideas and techniques. This is NOT a get rich quick scheme. The way the Client implements the System and the time invested in it, will determine his own level of success. The Client’s knowledge of photography and service to his own clients will be a factor of success. Because each individual has a different profile, we cannot guarantee any level of business or financial success. We cannot be held responsible for any of the Client’s actions. All comments pertaining to future results of our System are intended to show possibilities of potential earnings.

MINIMUM GUARANTEES

The System comes with a 90-day guarantee. Other members of the Team of Experts may offer different guarantees, so be careful in checking their own policies.
If by any chance the Client do not understand or agree with any of these conditions, we suggest you do not proceed in purchasing the System.For further information, please contact us at contact@photocoachonline.com

FEES

The price payable for the products offered by the Company is the one posted on this website. Prices are in Canadian dollars, except for the products offered through a direct link to our Experts websites; in which case, the Client will pay the price in the Expert’s selected denominations.
The fee for “PhotoCoach “Core” Business System” are the following two options: 2 equal payment of $448.50 plus applicable taxes (in Canada only) (due today and in 30 days) or 5 monthly payments of $209.10 plus applicable taxes (in Canada only). If you select the 5 monthly payments, you will pay the first instalment today of $209.10 plus applicable taxes (in Canada only), and $209.10 plus applicable taxes each month for an additional 4 months from the date of purchase, for a total payment of $1,045.50 plus applicable taxes (in Canada only). If you choose to pick this option, you are responsible for all 5 payments unless a refund is requested according to the terms further outlined below. Please note that if you choose the 5 payment options, PhotoCoach International and Gestion Amya inc retain the right to suspend access to any program if payments are not made as they are due.
Further, if at any time if there is a past due payment, access to the program will be temporarily restricted until the account is in current financial standing. Each monthly invoice only indicates the payment and balance due for the current month listed on that individual invoice, and does not reflect the ongoing or remaining balance for the account. SETUP AND PAYMENT

The Client represents and warrants that (i) the credit card information supplied is true, correct and complete and (ii) charges incurred by the Client will be honoured by the Client ‘s credit card company and (iii) Client shall pay charges incurred by Client at the amounts in effect at the time incurred, including all applicable taxes. Client shall be responsible for all charges incurred through use of Client ‘s password. Client agrees to keep his or her password confidential and to notify Company within 24 hours of any breach of this Contract or unauthorized use of the password. Company does not protect Client from unauthorized use of Client ‘s password.
The amount of the purchase showing on the Client’s credit card statement will appear in Canadian dollars converted into the Client’s currency.
Taxes are applicable for purchases done by Canadian clients following the table below:

PHOTOCOACH “CORE” BUSINESS SYSTEM” REFUND POLICY

PhotoCoach International wants you to be totally satisfied with the purchase of the System. However, we want you to invest time and best effort to implement the concepts, ideas and strategies of the System. We offer a 90-day refund period for the purchase of the System. However, in order to qualify for a refund, you must submit us with proof that you did all the suggested practical exercises in the System and the anticipated results were not there. Please note, if you select the 5 payment option, we are not able to stop payments without a refund request to be submitted.In the eventuality that you conclude this purchase of the System was not the right decision within 90 days of enrolment, contact our support team at contact@photocoachonline.com and let us know you’d like a refund by the 90th day at 23:59hres EDT. However, you must include a copy of the completed System material with your request for a refund. If you request a refund and do not include your practical exercises by the 90th day, you will not be granted a refund.The work that you need to submit with your request for a refund includes ALL of the following items:Refunds are NOT eligible after more than 90 days following the date of purchase. After day 90, all payments are non-refundable and you are responsible for full payment of the fees for the program regardless if you complete the System or not.

PLEASE NOTE: If you opted for the 2 months or 5 months payment plans and you do not request a refund within 90 days, with the required completed System material at the time of your refund request, you are required by law to complete the remaining payments of either payment plan.All refunds are optional as determined by Gestion Amya inc and PhotoCoach International. To clarify, we will not provide refunds after the 90th day from your date of purchase. All payments must be made on a timely basis. In the event that payments are not made on time, you, the Client, agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.If you have any questions or problems, please contact our customer service team immediately. ​The “PhotoCoach “Core” Business System” and any other product available on the www.photocoachonline.com website are copyrighted and original materials that have been provided to Client are for Client’s individual use only and a single-user licence.The content, organization, gathering, compilation, magnetic translation, digital conversion and other matters related to the www.photocoachonline.com site are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights, and, the copying, redistribution, use or publication by a Client of any such content or any part of the www.photocoachonline.com site, PhotoCoach “Core” Business System and all other PhotoCoach programs or products, is prohibited. All intellectual property, including Company’s copyrighted System and/or course materials, shall remain the sole property of the PhotoCoach International. No licence to sell or distribute Company’s materials is granted or implied.All third-party programs and products available on the www.photocoachonline.com website are copyrighted with their own authors. PhotoCoach International and Gestion Amya inc are not responsible for any violation or infringements on the part of the Client or any other party.Client agrees not to disclose such information to any other person or use it in any manner other than in discussion with the Company. Further, by purchasing any of these products, Client agrees that if Client violates, or displays any likelihood of violating, any of Client’s agreements contained in this paragraph, the Company will be entitled to injunctive relief to prohibit any such violations and to protect against the harm of such violations.

RIGHT TO REFUSE

​Company reserves the right in its sole discretion to refuse service at any time. Sale of any goods or services is subject to availability.Indemnification Client agrees to indemnify, defend and hold Company and its affiliates, licensors and suppliers harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, related to a Client’s violation of this Contract or use of the www.photocoachonline.com site.Non-Transferable Client’s right to use the Service is not transferable and is subject to any limits established by Company or by Client’s credit card company.

Those terms and conditions can be amended at any time by Gestion Amya Inc. (PhotoCoach International). By accessing the Site, you confirm having read and understood these conditions. If you do not wish to be bound by these terms and conditions, you cannot use the Site to order services or products from.

Price

The purchase price for each product ordered is the one that appears directly facing that product on the Site. All prices are in Canadian dollars. Credit card companies will convert your Canadian dollar purchase to your own currency on the credit card statement from your bank or financial institution.

The applicable sales taxes are over and above the product price.

Gestion Amya Inc. (PhotoCoach International) reserves the right to change the price of any product offered on the Site at any time and without prior notice.
